Some of our service providers (for example, cloud hosting, email and analytics providers) are located outside New Zealand, or may store information outside New Zealand, including in Australia, the United States and the European Union. By providing your personal information to us, you consent to that information being held and processed overseas. Where personal information is transferred overseas, we take reasonable steps to ensure it is protected by safeguards comparable to those in New Zealand.

6. Cookies, tracking and digital marketing

Our website and emails use cookies, pixels, tags and similar technologies (together, "tracking technologies") to operate the site, remember your preferences, measure how the site is used, and deliver and measure marketing.

The tracking technologies we use fall into the following categories:

  • Strictly necessary: required for the site to function (for example, security, load balancing, remembering form input).
  • Functional: remember your preferences and settings to improve your experience.
  • Analytics and performance: help us understand how visitors use the site so we can improve it (for example, which pages are visited, how long people stay, where they drop off).
  • Advertising and marketing: used by us and our advertising partners to deliver relevant advertising to you on our website and on third-party platforms (including search engines and social media), measure the performance of those campaigns, and tailor what you see based on your activity.

Custom audiences and matched marketing

We may share limited personal information you have provided to us (such as a hashed, one-way encrypted version of your email address or phone number) with advertising and marketing platforms in order to:

  • show our ads to you on those platforms
  • suppress our ads from existing customers, or show them different content
  • build "lookalike" audiences of people whose profile matches our customer base
  • measure the performance of our marketing

Where we do this, the platform receives information in a hashed form and is not permitted to use it for its own purposes.

Cross-device tracking

Some of the tracking technologies we use can recognise the same person across different devices (for example, your phone and your laptop) where you have logged in to a connected service or where the platform's own technology can match the activity.

Your choices

You can manage tracking technologies in several ways:

  • Browser settings: most browsers let you block, accept or delete cookies. You can also use private browsing or "do not track" modes.
  • Ad platform settings: most major search and social media platforms (such as Google, Meta, TikTok and LinkedIn) offer opt-out and personalisation controls within their account settings.
  • Industry opt-outs: visit youronlinechoices.com.au or aboutads.info to opt out of behavioural advertising from many advertising networks.
  • Marketing emails and SMS: use the unsubscribe link in any email, reply STOP to any text, or contact our Privacy Officer.

Disabling certain tracking technologies may mean parts of the site do not work as intended.

Third-party websites

Our site may link to third-party websites. Their tracking and privacy practices are governed by their own policies, not ours.

7. Storage and security

We hold personal information in secure systems (electronic and, where relevant, physical) and take reasonable steps to protect it from loss, misuse, unauthorised access, modification or disclosure. We retain personal information only for as long as necessary for the purposes for which it was collected, or as required by law.

8. Your rights

You have the right to:

  • ask whether we hold personal information about you
  • request access to that information
  • request correction of any information that is wrong
  • withdraw any consent you have given (subject to legal or contractual exceptions)
  • make a complaint about how we have handled your information

To exercise any of these rights, please contact our Privacy Officer (see Section C). If you are not satisfied with our response, you can contact the Office of the Privacy Commissioner at privacy.org.nz or 0800 803 909.

9. Marketing communications

Where you have opted in to marketing, or where it is permitted by law, we may send you communications about products, services, offers or updates from the Movogo Group. You can unsubscribe at any time using the link in any marketing email, or by contacting us.

10. Children

Our products and services are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe we have inadvertently collected information from a child, please contact us so we can delete it.

11. Changes to this Policy

We may update this Policy from time to time. The current version will always be available at movogo.co.nz. The "Last updated" date at the top of this Policy tells you when it was most recently changed. Continued use of our website or services after a change is published means you accept the updated Policy.

Section B: Privacy Waiver (Finance and Credit Applications)

This Privacy Waiver applies when you submit an application for finance, refinance or any other credit-related product through any company in the Movogo Group. It is in addition to, and should be read together with, the Privacy Policy in Section A.

The Movogo Group includes companies that provide finance directly to customers as the finance provider, and (in some cases) brokers and intermediaries that refer applications to a finance provider. When you submit an application, it may be:

  • received and assessed by a Movogo Group company as the finance provider; or
  • referred to a Movogo Group finance provider by a related broker or intermediary; or
  • where we are unable to provide finance ourselves, referred (with your consent) to one or more third-party finance companies (each a "Finance Provider") for assessment.

You have the right to know who is collecting information about you, and to access and correct it if it is wrong. You may request the full details of every organisation or person to whom we have disclosed information about you.

You consent to the Movogo Group, and to any Finance Provider to whom your application is referred, collecting, using and disclosing your personal information within New Zealand or Australia for the purposes set out below.

1. Verification of information

Verifying any information that you give to us (or that is collected from other sources) with third parties and third-party databases, including government agencies (for example, the New Zealand Transport Agency, Motor Vehicle Register, PPSR and Ministry of Justice), your employer, any bank or other financial institution you have or have had credit or a mortgage with, local authorities, your landlord, any property manager or real estate agency (including any solicitor acting for one of these parties), and related companies of the Movogo Group or a Finance Provider, in order to:

  • verify your identity now or in the future
  • verify the information in this or any subsequent application
  • consider your financial position
  • consider whether any proposed security has money owing in relation to it
  • register security interests
  • protect any security taken
  • enforce rights if a default occurs

Information collected for the purposes set out above may also be used by the Movogo Group, and by any Finance Provider, to contact you in connection with your application, any resulting account, or any default, using any of the contact details we hold for you (whether provided by you or collected from third parties).

2. Credit checks and credit reporting

Carrying out credit checks on you with credit reporting agencies for the purpose of:

  • assessing your application for finance
  • making a credit decision now or in the future
  • ongoing account review (where applicable)
  • debt collection
  • complying with the AML/CFT Act

This will require the Movogo Group and/or any Finance Provider to give your information to credit reporting agencies, and for those agencies to provide information about you to the Movogo Group and the relevant Finance Provider.

You acknowledge and agree that:

  • where your application is referred to more than one Finance Provider, more than one credit report may be obtained in connection with your application, and
  • each Finance Provider may independently assess your application and conduct its own credit and verification checks.

The Movogo Group, or a Finance Provider, may disclose your positive credit information (including repayment history information) and any defaults to credit reporting agencies. Information disclosed to credit reporting agencies may be listed on their systems, used by them to provide credit reporting services, and supplied to their customers who use those services to make credit decisions about you, for debt collection, or for any other lawful purpose.

3. Ministry of Justice checks

Checking the Ministry of Justice fines database for any overdue fines you may have. This may require your information to be disclosed to the Ministry of Justice, or to a credit reporting agency conducting the check on our behalf.

4. AML/CFT and fraud prevention

Verifying any information that you give to us (or that is collected from other sources) with third parties and third-party databases for the purposes of fraud prevention and compliance with the AML/CFT Act. Where you have voluntarily provided your driver licence information, that information may also be disclosed to credit reporting agencies, the New Zealand Transport Agency and the Ministry of Justice as part of the checks undertaken.

5. Disclosure to related companies and product partners

Sharing information with related companies in the Movogo Group, or with related companies of a Finance Provider, for the purposes of conducting business operations and/or in connection with services or products that may be offered to you. This may include sharing your information with insurers or other product partners where you request, or take up, an insurance or related product distributed by the Movogo Group in connection with your finance.

6. Authority and duration

You authorise any third party to provide your personal information to the Movogo Group and/or any Finance Provider for any of the purposes set out in this Privacy Waiver. You authorise those parties to hold and disclose such information for the purposes set out above.

This authority applies whether or not your application proceeds, and remains valid for the purpose of assessing this application and any future application made by you through any company in the Movogo Group.
